These Terms and Conditions apply to all use of our website, online store, in-person experiences, pop-up locations, and any services or products provided by us.

By purchasing, booking, participating, or using our website or equipment, you agree to these Terms and Conditions.

1. Eligibility and Participation

  • Our experiences are intended for persons aged 8 years and over
  • Participants under 18 must be supervised by a parent or legal guardian
  • Some vehicles, experiences, or equipment may have higher age or skill requirements
  • We reserve the right to modify age or experience requirements at any time without notice

Participation is at our discretion.

2. Behaviour and Safety

We reserve the right to refuse, revoke, or terminate access without refund if a participant:

  • Appears unable to safely operate equipment
  • Repeatedly crashes, misuses, or abuses vehicles
  • Intentionally or recklessly damages vehicles or equipment
  • Damages controllers, steering wheels, VR headsets, screens, displays, or any property
  • Fails to follow instructions or staff direction
  • Behaves in a disruptive, unsafe, or inappropriate manner

Our decision is final.

3. Damage, Loss, and Liability

  • Participants are responsible for any damage caused by misuse, negligence, or reckless behaviour
  • If the participant is a minor, their parent or legal guardian is fully responsible
  • We reserve the right to recover repair or replacement costs for damaged equipment, including but not limited to:
    • Vehicles
    • Controllers
    • Steering wheels
    • VR headsets
    • Screens, displays, or track components
    • Any associated accessories or property

Costs may be charged to the original payment method or invoiced.

4. VR and Health Warnings

Some experiences may involve virtual reality or simulated environments.

  • VR may cause dizziness, nausea, fatigue, motion sickness, or discomfort
  • VR experiences are not recommended for individuals with epilepsy, seizure disorders, or similar conditions
  • You participate at your own risk and must immediately stop if you feel unwell

We accept no responsibility for health effects arising from participation.

5. No Refunds for Removal or Misuse

No refunds will be provided where:

  • Access is revoked due to behaviour or misuse
  • Equipment is intentionally or negligently damaged
  • Instructions or safety rules are ignored
  • A participant chooses to stop early

6. Online Orders and Products

  • Product descriptions and images are indicative only
  • Products may be modified, prepared, tested, or configured prior to sale
  • Packaging may appear opened or resealed as part of standard preparation

7. Warranty Policy

General Warranty

  • Products are covered by a 12-month warranty from the date of purchase unless stated otherwise
  • Warranty covers manufacturing defects only

Warranty Exclusions

Warranty is void where damage results from, including but not limited to:

  • Physical impact, crashes, or collisions
  • Broken or worn wheels, tyres, suspension, or driveline components
  • Water, moisture, dust, or debris ingress
  • Improper use, misuse, abuse, or neglect
  • Unauthorised modifications or repairs
  • Normal wear and tear
  • Incorrect battery use, charging, or storage
  • Use outside intended environments

If a product appears smashed, cracked, bent, or structurally compromised, warranty is void.

Batteries

  • Vehicles may or may not be supplied with batteries depending on logistics and shipping methods
  • Battery inclusion is not guaranteed unless explicitly stated
  • Battery damage or misuse is not covered under warranty

Modified Products

  • Some products may be modified or adjusted prior to sale
  • Resealed packaging is normal and does not affect warranty coverage

Collector Items

  • Collector or limited-edition items are covered only by the original manufacturer’s warranty
  • We do not repair or replace collector items directly

8. Returns and Refunds

  • Change-of-mind returns are not guaranteed
  • Refunds are assessed on a case-by-case basis
  • Shipping, handling, and processing fees are non-refundable
  • Damaged, used, or altered products are not eligible for return

9. Intellectual Property

All content on our website and premises, including logos, designs, images, videos, and branding, remains our intellectual property and may not be used without permission.

10. Limitation of Liability

To the maximum extent permitted by Australian law:

  • We are not liable for indirect, incidental, or consequential loss
  • Participation is at your own risk
  • Our liability is limited to resupply or refund as required under Australian Consumer Law

Nothing in these Terms excludes non-excludable consumer guarantees.

Personal information is handled in accordance with our Privacy Policy.

12. Changes to Terms

We may update these Terms and Conditions at any time.

Continued use of our services constitutes acceptance of the updated Terms.
