Liability Waiver & Assumption of Risk

By participating in any experience, event, activity, or use of equipment provided by us, you acknowledge, accept, and agree to the following terms.

This waiver applies to all participants, including spectators, customers, guests, and guardians.

1. Assumption of Risk

You acknowledge and agree that participation in remote-controlled vehicle activities, virtual reality experiences, and related equipment involves inherent risks, including but not limited to:

  • Vehicles leaving the track
  • Vehicles striking people, objects, or property
  • Collisions, impacts, and high-speed movement
  • Flying debris or broken components
  • Electrical faults or battery failures
  • Fire, smoke, sparks, or heat generation
  • Slips, trips, and falls within the venue
  • Damage to personal belongings

You voluntarily assume all risks, whether foreseeable or unforeseeable.

2. Injury and Health Risks

You acknowledge that participation may result in:

  • Cuts, bruises, burns, fractures, or serious injury
  • Eye injuries from debris or impact
  • Aggravation of existing medical conditions

Virtual reality experiences may cause:

  • Dizziness, nausea, motion sickness, fatigue
  • Disorientation or loss of balance
  • Headaches or visual discomfort

VR experiences are not recommended for individuals with epilepsy, seizure disorders, or sensitivity to flashing lights.

You confirm you are physically and medically fit to participate.

3. Epilepsy and Neurological Warning

Some experiences may involve:

  • Rapid movement
  • Flashing visuals
  • Simulated environments

These may trigger seizures or neurological responses in susceptible individuals.

Participation is entirely at your own risk.

4. Radio Frequency and Interference Risks

You acknowledge that:

  • Equipment may operate using wireless radio frequencies
  • Interference may occur from external sources
  • Signal disruption, latency, or loss of control may occur
  • Interference may cause unexpected vehicle movement or behaviour

You accept all risks associated with wireless operation.

5. Property Damage

You accept responsibility for:

  • Damage to venue property
  • Damage to equipment provided
  • Damage caused to third parties

If the participant is a minor, the parent or legal guardian accepts full responsibility.

6. Minors

  • Participants under 18 must be supervised by a parent or legal guardian
  • Guardians consent on behalf of the minor
  • Guardians assume full responsibility for the minor’s actions and participation

7. Release of Liability

To the maximum extent permitted by Australian law, you release, waive, and discharge us from any and all claims, demands, actions, or liabilities arising from:

  • Personal injury
  • Property damage
  • Loss or damage to personal belongings
  • Illness or health effects
  • Equipment malfunction or failure

This includes negligence to the extent permitted by law.

8. Indemnity

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from:

  • Your participation
  • Your actions or misuse of equipment
  • Breach of venue rules or instructions

9. No Responsibility for Personal Belongings

We are not responsible for loss or damage to personal items, including phones, glasses, clothing, or accessories.

By participating, you confirm that:

  • You have read and understood this waiver
  • You accept the risks involved
  • You agree to be bound by these terms

This waiver remains in effect for all future visits unless revoked in writing.
